Terms and conditions
Last updated: September 2026.
Who you are contracting with
These terms are between you and EarShots.Dev, the legal entity that owns and operates the service. EarShots is the product name we use in our interface and marketing. By creating an account or using the service, you agree to them. If you use EarShots for a company, you confirm you have the authority to bind that company. If you use it as an individual, you confirm you are of legal age in your country.
The service
EarShots finds public conversations about your product across developer communities, sorts them, and drafts replies grounded in documentation you provide. Every draft is a suggestion. A person on your team reviews, edits, and approves each reply, and replies are sent by a person from the original post. EarShots never posts on your behalf automatically.
We grant you a limited, non-exclusive, non-transferable right to use the service within your plan for the length of your subscription.
Your account
Keep your credentials confidential. You are responsible for everything that happens under your account. Give us accurate information and keep it up to date.
Acceptable use
You must not misuse the service. That means no:
- Unlawful use, fraud, or spam.
- Infringing anyone's intellectual property.
- Malware, probing, or interfering with the security of the service or any network.
- Scraping the service itself, or reselling or redistributing access to it.
- Reverse engineering the service or circumventing plan limits and technical controls.
AI drafting rules
EarShots uses AI to sort conversations and draft replies. You are responsible for your inputs, for having the rights to the documentation and content you upload, for how you use the output, and for checking a draft's accuracy before it is sent. Drafts can be wrong. They are not professional, legal, financial, or medical advice, and they are not a substitute for your own review.
You must not use the AI features to generate illegal content, deepfakes, hate speech, malware, or attempts to bypass safety systems.
You keep your rights in the content you provide. Drafts created for your workspace are yours to use. If a rights holder believes content in the service infringes their rights, they can contact us at legal@earshots.dev and we will review and remove it where warranted. Repeated infringement by a user can lead to suspension or termination.
We may moderate content in the service: we can remove or restrict content, refuse or filter outputs, and suspend accounts that break these rules.
Your content
You grant EarShots a limited license to host and process the content you provide, only as needed to run the service for you. We do not claim ownership of your documentation, workspace data, or drafts.
Billing, cancellation, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, subscription renewal, and cancellation mechanics are governed by Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms. Subscriptions renew monthly until cancelled. You can cancel any time from the billing page, and cancellation takes effect at the end of the current billing period. Refunds are covered by our refund policy at /refund.
Service level
We work to keep EarShots available and accurate, but we do not guarantee uninterrupted or error-free performance. Listening coverage depends on public sources we do not control, and those sources can change or become unavailable.
Intellectual property
EarShots owns the service and its intellectual property: the software, documentation, and branding. These terms do not transfer any of that to you.
Suspension and termination
We can suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated and serious policy violations. When your access ends, your workspace data is handled under the privacy notice. You can export or request a copy before deletion by contacting us.
Liability
The service is provided as is, and we disclaim implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent the law allows. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Our total liability to you is capped at the fees you paid in the twelve months before the claim. Nothing in these terms limits liability for fraud, death, or personal injury where the law does not allow it.
Indemnity
You indemnify EarShots against claims arising from your content, your unlawful use of the service, or your violation of these terms.
General
You may not assign these terms without our consent. We may assign them in connection with a merger or acquisition. Neither of us is liable for failures caused by events beyond reasonable control. If a court finds part of these terms unenforceable, the rest still applies. These terms are governed by the laws of the State of California, and disputes will be heard in its courts, unless the law where you live gives you a mandatory different venue.
